Terms of Service

These Terms of Service ("Terms") govern your use of Kushify's cannabis operations platform (the "Service"). By accessing or using the Service, you agree to be bound by these Terms. If you are accepting on behalf of an entity, you represent that you have authority to bind that entity.

Kushify provides a hosted software platform for licensed cannabis operators, including point-of-sale, e-commerce, delivery dispatch, compliance, and reporting features. The specific features available to you depend on your subscription tier.

You may only use the Service if you operate a licensed cannabis business in a jurisdiction where such operation is legal under applicable state or local law, and you comply with all applicable cannabis regulations. You are responsible for maintaining your operator licenses in good standing.

You retain all rights to your data. We process your data to operate the Service and as described in our Privacy Policy. You grant us a license to use your data only to the extent necessary to provide the Service.

Subscription fees are billed monthly in advance per storefront. Fees are non-refundable except as required by law. We may change our pricing with 30 days' notice; changes apply to subsequent billing cycles, not the current one. Payment-processor fees (Aeropay, Sprout, etc.) are paid directly to those providers and are not part of your Kushify subscription.

You will not use the Service to: violate any law or regulation; transmit malicious code; attempt to gain unauthorized access to the Service or other accounts; resell or sublicense the Service without our written consent; or use the Service in any manner that could damage, disable, or impair the Service or interfere with any other party's use.

While Kushify provides compliance tooling, you remain responsible for your cannabis operations' compliance with all applicable laws and regulations. We are not a substitute for legal counsel or a licensed compliance officer.

You may terminate your subscription at any time effective the end of your current billing cycle. We may terminate or suspend your account for material breach of these Terms with written notice. Upon termination, you have 90 days to export your data; after that period, data is deleted in accordance with our retention policy.

THE SERVICE IS PROVIDED "AS IS" WITHOUT WARRANTY OF ANY KIND. WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT, TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, KUSHIFY'S TOTAL LIABILITY ARISING FROM OR RELATED TO THIS AGREEMENT SHALL NOT EXCEED THE FEES PAID BY YOU TO KUSHIFY IN THE 12 MONTHS PRECEDING THE EVENT GIVING RISE TO THE LIABILITY. IN NO EVENT SHALL KUSHIFY BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, OR CONSEQUENTIAL DAMAGES.

These Terms are governed by the laws of the State of California, without regard to conflict of law principles. Any disputes shall be resolved in the state or federal courts located in Los Angeles County, California.

We may update these Terms from time to time. Material changes will be communicated to operator account owners via email at least 30 days in advance. Continued use of the Service after the effective date constitutes acceptance of the updated Terms.
